2. Scope of Application

These General Terms and Conditions ("T&C") govern all contracts concluded between Kartono and its customers via the Kartono online shop. By placing an order on our website, you accept these T&C in full. Kartono reserves the right to refuse service to anyone at its sole discretion.

These T&C apply to consumers (natural persons acting outside of their trade, business, craft, or profession) and to business customers placing orders through the Kartono platform. Where a provision applies only to consumers, this is stated explicitly.

To make use of the offers, individuals must be at least 18 years old. If delivery times are stated in (working) days, this shall be understood to mean all weekdays excluding Saturdays, Sundays, and public holidays.

3. Contract Conclusion

3.1 The presentation of products on our website constitutes an invitation to submit an offer — not a binding offer from Kartono.

3.2 By clicking the "Order with obligation to pay" button, you submit a binding purchase offer for the items in your cart.

3.3 An automated order receipt email does not constitute acceptance of your order.

3.4 A binding contract is formed only when Kartono sends a separate order confirmation email or physically dispatches the goods, whichever occurs first.

3.5 Kartono reserves the right to reject any order at its discretion, including orders suspected of fraud, abuse, or violation of these T&C, with a full refund and no further obligation.

4. Registration & Customer Account

4.1 Registration for a customer account is free and voluntary, though certain features require an account.

4.2 You must ensure all account information is accurate and current. Providing false or misleading information is grounds for immediate account termination.

4.3 You are solely responsible for maintaining the confidentiality of your login credentials. Kartono is not liable for any loss or damage arising from unauthorised access to your account.

4.4 Kartono reserves the right to suspend or permanently close any account that violates these T&C, is involved in fraud, or has been inactive for an extended period, without prior notice.

5. Prices & VAT

5.1 All prices are shown in Euros (€) and include applicable Belgian VAT unless stated otherwise.

5.2 Prices are subject to change at any time prior to order confirmation. The price confirmed in your order confirmation email is the binding price.

5.3 Delivery and handling costs are shown separately at checkout and are not included in the displayed product price.

5.4 Kartono is not responsible for price discrepancies caused by browser caching, display errors, or third-party comparison tools. The price shown at final checkout and confirmed by email is the only binding price.

6. Payment

6.1 Available payment methods are shown at checkout and may be updated at any time without prior notice.

6.2 Full payment is due at the time of ordering unless otherwise stated at checkout.

6.3 By placing an order, you consent to receiving invoices from Kartono in electronic format.

6.4 Kartono reserves the right to withhold dispatch of goods until payment has been confirmed and cleared.

6.5 In the event of a failed, disputed, or fraudulent payment, Kartono reserves the right to cancel the order and suspend the associated account without liability. Initiating a chargeback or payment dispute while Kartono's own dispute resolution process is active may result in immediate account suspension. Kartono reserves the right to pursue recovery of all costs and losses resulting from fraudulent or unjustified chargebacks, including administrative and legal fees.

7. Delivery & Shipping

7.1 Kartono delivers to countries as indicated at checkout. Delivery to regions not listed is not available. It is the customer's responsibility to verify that delivery to their address is available before placing an order.

7.2 Delivery costs shown at checkout cover standard ground floor delivery only — meaning delivery to the entrance of the building or ground floor of the delivery address. The quoted delivery cost does not include, and Kartono bears no responsibility for, any additional services such as:

  • Use of elevators, hoists, or lifting equipment
  • Removal or disposal of old or existing furniture
  • Navigation through narrow corridors, staircases, or restricted access points

Any additional services must be arranged and paid for directly by the customer with the transport or delivery company. Kartono is not a party to any such agreement and accepts no liability for costs, delays, or damages arising from additional delivery services.

7.3 It is the customer's sole responsibility to ensure the delivery address is accessible for the size and weight of the ordered goods, including adequate door widths, stairwell dimensions, lift capacity, and parking for delivery vehicles. If delivery cannot be completed due to access issues at the customer's premises, any re-delivery, storage, or return costs are borne entirely by the customer.

7.4 All delivery times are estimates only and are not contractually binding. Kartono is not liable for delays caused by carriers, customs authorities, supplier disruptions, force majeure events, or other circumstances beyond its reasonable control. Delivery delays do not entitle the customer to cancel the order or claim compensation, except where expressly required by applicable mandatory consumer law.

7.5 Risk of loss and damage passes to the customer upon delivery to the address provided at checkout. If a delivery is refused, fails due to an incorrect address, or is returned to sender due to customer error, any re-delivery and return costs are borne by the customer and may be deducted from any refund issued.

7.6 The customer or a designated adult representative must be present at the delivery address at the agreed delivery time. If no authorised person is available and the carrier cannot safely leave the goods, a re-delivery attempt may be made at additional cost to the customer.

7.7 Upon receipt, the customer must inspect all goods and note any visible damage on the carrier's delivery document before signing. Signing without reservation constitutes acceptance of the goods in apparently good condition. Any visible damage or discrepancy must be reported to Kartono at legal@kartono.eu within 5 calendar days of delivery. Claims submitted after this window may not be accepted.

8. Product Availability & Pricing Errors

8.1 All listings are subject to availability. Kartono reserves the right to cancel any order — in full or in part — where a product becomes out of stock, is discontinued, or cannot be sourced from its supplier. Kartono's liability in such cases is limited solely to a full refund of the amount paid for the unavailable item(s).

8.2 In the event of a manifest pricing error — including prices that are clearly incorrect due to a technical glitch, administrative mistake, or system error — Kartono reserves the right to cancel the affected order before dispatch and issue a full refund. No binding contract is formed where a pricing error is manifest. Kartono will notify the customer promptly.

8.3 Kartono makes reasonable efforts to ensure product descriptions, dimensions, colours, and images are accurate. However, minor variations may occur, particularly with handmade or natural-material products. Such minor variations do not constitute a defect or grounds for cancellation.

9. Personal Use & Reseller Prohibition

9.1 The Kartono platform is intended exclusively for end-consumers purchasing goods for personal, private, and domestic use.

9.2 Purchasing goods for commercial resale, redistribution, dropshipping, or fulfilment of third-party orders is strictly prohibited without prior written agreement from Kartono.

9.3 Kartono reserves the right to cancel any order, limit quantities per customer or address, or suspend any account where it reasonably suspects commercial purchasing behaviour. In such cases, Kartono will issue a refund and bears no further liability. Repeated violations may result in permanent account banning and referral to relevant authorities where applicable.

10. Vouchers & Promotional Codes

10.1 Vouchers and promotional codes are valid only during their stated validity period and cannot be combined with other discounts unless explicitly stated.

10.2 Vouchers have no cash value and cannot be exchanged for cash or credit.

10.3 If the order total exceeds the voucher value, the balance is payable by a valid payment method. Any unused voucher value remaining after an order remains on the voucher until expiry where the system supports this; otherwise the remaining balance lapses.

10.4 Kartono reserves the right to invalidate vouchers that are obtained fraudulently, used in violation of their terms, or applied to orders later cancelled for abuse.

11. Retention of Title

All goods remain the sole property of Kartono until payment has been received in full and cleared. In the event of payment default, Kartono reserves the right to demand return of the goods and take all necessary legal steps to recover them.

12. Intellectual Property & User Content

12.1 All content on the Kartono website — including product images, descriptions, logos, graphics, and design — is the exclusive property of Kartono or its licensors and is protected by copyright and intellectual property law. Any reproduction, distribution, or commercial use without prior written consent from Kartono is prohibited and may result in legal action.

12.2 Where Kartono enables customers to submit reviews, ratings, or other user-generated content, you grant Kartono a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, and publish that content for any lawful purpose. You warrant that any content you submit does not infringe third-party rights and does not contain false, defamatory, or illegal material.

12.3 Kartono reserves the right to remove or edit any user content at its sole discretion, without prior notice or explanation.

13. Limitation of Liability

13.1 To the maximum extent permitted by law, Kartono's total liability is limited to the amount paid by the customer for the product(s) giving rise to the claim.

13.2 Kartono is not liable for indirect, incidental, special, or consequential damages including loss of profit, data, or goodwill.

13.3 Nothing in these T&C shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any liability which cannot be excluded by applicable law.

14. Force Majeure

Kartono is not liable for failure or delay in performance caused by events beyond its reasonable control, including but not limited to natural disasters, pandemics, government actions, war, terrorism, supply chain disruptions, labour strikes, energy shortages, cyberattacks, or carrier failures.

15. Data Protection

Personal data is processed in accordance with Kartono's Privacy Policy, which forms part of these T&C. By using the Kartono website, you acknowledge and accept the data practices outlined in the Privacy Policy.

16. Governing Law & Jurisdiction

16.1 These T&C are governed by the laws of Belgium, without regard to conflict-of-law principles.

16.2 For consumers: mandatory consumer protection laws of your country of residence apply in addition. Any dispute shall be submitted to the competent courts of the consumer's place of residence or to the courts of Antwerp, Belgium, at the consumer's choice.

16.3 For business customers: any dispute shall be exclusively submitted to the courts of Antwerp, Belgium.

17. Severability

If any provision of these T&C is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced by a valid provision that most closely reflects its original intent.

18. Amendments

Kartono reserves the right to amend these T&C at any time. The current version is always published on our website. Continued use of the website after changes constitutes acceptance. Where changes materially affect existing orders, customers will be notified.

1. Statutory Right of Withdrawal

If you are a consumer (a natural person acting outside of any trade, business, or profession), you have the right under EU Directive 2011/83/EU and Belgian law (Book VI of the Code of Economic Law) to withdraw from your purchase within 14 calendar days of receiving the goods, without giving any reason.

This 14-day period begins on the day you, or a third party you have designated (other than the carrier), physically take possession of the goods. For orders containing multiple items delivered separately, the period begins upon receipt of the last item.

2. How to Exercise Your Right of Withdrawal

You must notify Kartono of your decision to withdraw before the 14-day deadline using a clear, unambiguous written statement. You may do so by:

The withdrawal is timely if the notification is sent before midnight on the last day of the 14-day period.

3. Return Shipping — Customer Responsibility

You must return the goods without undue delay and in any event no later than 14 calendar days after the date on which you notified us of your withdrawal.

The full cost of return shipping is borne by you, the customer. Kartono does not provide prepaid return labels, return packaging, or collection services.

To obtain the correct return address and handover instructions, you must contact us before shipping at legal@kartono.eu.

We strongly recommend using a trackable and insured shipping method. Kartono accepts no liability for goods lost, stolen, or damaged during return transit.

4. Condition of Returned Goods

You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning. Goods that are used, damaged, incomplete, or returned without original packaging may be subject to a deduction from the refund. In cases of significant damage or misuse, Kartono reserves the right to refuse the return entirely.

5. Refund

Kartono will process your refund within 14 calendar days of receiving the returned goods and confirming their condition. We may withhold the refund until the goods have been physically received and inspected.

The refund covers the purchase price of the returned item(s) only. Original outbound shipping costs paid by the customer are not refunded, except where the return is due to an error by Kartono or a confirmed product defect.

Refunds are issued via the same payment method used for the original purchase.

6. Items Excluded from the Right of Withdrawal

The statutory right of withdrawal does not apply to:

  • Custom-made or personalised items produced to your specifications
  • Sealed goods that cannot be returned for hygiene or health protection reasons, where the seal has been broken after delivery
  • Goods that have been irreversibly mixed with other items after delivery
  • Digital content that has been accessed, downloaded, or streamed after you gave explicit consent
  • Gift cards and vouchers
  • Perishable goods or goods with a short shelf life

7. No Additional or Voluntary Return Rights

Kartono does not offer any extended, voluntary, or goodwill return period beyond the 14-day statutory right of withdrawal described above. No returns will be accepted after the withdrawal period has expired, except in cases of a valid warranty or defect claim under Section 8.

8. Defective or Incorrect Items

If you receive a defective, damaged, or incorrect item, your statutory warranty rights under Belgian law (minimum 2-year legal guarantee under EU Directive 2019/771) apply independently of this return policy. 1. Statutory Legal Guarantee

Under Belgian law and EU Directive 2019/771, all products sold by Kartono carry a minimum 2-year legal guarantee against defects that existed at the time of delivery. This guarantee covers:

  • Manufacturing defects
  • Material defects
  • Non-conformity with the product description published on our website at the time of purchase

If a defect appears within 12 months of delivery, it is legally presumed to have existed at delivery unless Kartono proves otherwise. After 12 months, the burden of proof shifts to the customer to demonstrate the defect existed at the time of delivery.

This 2-year statutory guarantee is the only guarantee provided by Kartono unless an additional written warranty is explicitly offered for a specific product at the time of purchase and confirmed in writing by Kartono management.

2. What Is Not Covered

The statutory guarantee does not apply to damage or defects caused by:

  • Normal wear and tear arising from ordinary use
  • Physical damage, impact, accidents, or misuse by the customer
  • Failure to follow assembly, installation, or care instructions provided with the product
  • Modifications, repairs, or alterations made by unauthorised parties
  • External factors such as water damage, fire, extreme temperatures, or improper storage
  • Use of the product for commercial or non-domestic purposes
  • Damage caused after delivery that is not attributable to a pre-existing manufacturing defect

3. How to Submit a Warranty Claim

Step 1: Contact Kartono at legal@kartono.eu with your order number, a clear description of the defect, and supporting photographs showing the issue.

Step 2: Kartono will assess your claim and respond within 5 business days. Kartono may request additional evidence or the return of the item for inspection at Kartono's cost if the defect is confirmed as valid.

Step 3: Where a valid defect is confirmed, Kartono will — at its sole discretion and in compliance with applicable law — offer one of the following remedies: repair, replacement with an equivalent product, a proportional price reduction, or a refund.

4. Warranty Limitations

No employee, agent, partner, or representative of Kartono is authorised to extend, modify, or create any warranty beyond the statutory minimum verbally or informally. Any warranty commitment beyond the 2-year legal guarantee must be issued in writing and signed by an authorised representative of Kartono management to be valid and enforceable.

5. Relationship to Return Policy

This warranty policy is separate from and independent of the Return & Refund Policy. Defect claims under this warranty policy may be raised after the 14-day statutory withdrawal period has expired.
